Preparing for the EU Machinery Regulation
The new EU Machinery Regulation (EU) 2023/1230 will apply from 20 January 2027, replacing the Machinery Directive 2006/42/EC. The Regulation establishes updated health and safety requirements for machinery and related products and introduces new obligations for relevant economic operators.
One area that deserves particular attention is machinery that undergoes a substantial modification. Under Article 18, a person carrying out a substantial modification that affects compliance can be considered the manufacturer for the purposes of the Regulation and may assume corresponding obligations.
