Eco-Compliance: Cheltenham waste operator charged over £47,000 for dumping red diesel
A Cheltenham waste operator has been ordered to pay £47,000 after deliberately emptying red diesel onto the ground during an HMRC inspection. The case is a sharp reminder that regulators are taking a firm line on pollution at waste sites across England, and it’s sure to be a warning to companies not engaging in eco-compliance best practices.
J. Gilder Earthmoving & Aggregates Ltd was sentenced at Gloucester Crown Court on 5 October 2026. The company had previously pleaded guilty to unlawfully discharging red diesel.
So, what happened? During an unannounced HMRC visit, staff delayed inspectors’ entry for more than two hours. During that time, or beforehand, red diesel was drained from a scalping screener onto the ground, leaving two large puddles for inspectors to find. Judge Rupert Lowe described it as “a deliberate and blatant attempt to get round the law.”
Firstly, the company was fined £12,000, ordered to pay £33,610.06 in costs, and charged a £2,000 statutory surcharge. The case sits within a wider crackdown. Since 2023, the Environment Agency has brought almost 250 waste-offence prosecutions, securing over £2.2 million in fines. In 2024/25 alone, it closed 743 illegal waste sites.
For businesses handling waste, fuel, or chemicals, the lesson is clear: spills must be reported, not hidden, and records need to stand up to scrutiny at short notice. FlexManager’s Eco-Compliance solutions are designed to help businesses reduce environmental risk and centralize records. By engaging with modules such as Environmental Incident, Waste Log, Environmental Audits, and Legal Register, you can report spills on the spot, track your waste, and stay ready for any legislative change.
